PRIZE
8. The prize consists of a cash amount of $50,000, made out in the winner’s name and issued by one of the Organizers within approximately three (3) weeks after having been declared winner.
9. The prize must be accepted as described in these rules and may not be exchanged or substituted by another prize.
GENERAL CONDITIONS
10. The reply forms (paper and electronic) received will be subject to verification by the Organizers. All incomplete, inaccurate, illegible, late or facsimile reply forms will be automatically cancelled. The Organizers’ decision to this effect is final and cannot be appealed.
11. All paper or electronic quote forms received will also be subject to verification by the Organizers. All incomplete, inaccurate, illegible, late or facsimile quote forms will be automatically cancelled. The Organizers’ decision to this effect is final and cannot be appealed.
12. The Organizers or their agents will attempt to contact (by phone, e-mail or mail) the person whose entry was selected at random, using the information on the reply form, quote form or the insurance policy, as the case may be. If the person in question cannot be reached within fourteen (14) days of the draw date, then the Organizers or their agents may draw another valid entry at random and will attempt to contact this person in the same manner and so on until someone is declared a winner.
13. Before being declared a winner, the person whose entry has been selected at random must answer correctly, without assistance and within a limited time period, a mathematical skill-testing question. The question will be submitted by phone to the randomly selected person, at a previously determined time. In the event of a correct response, the winning contestant will then be informed of how he/she can take possession of the prize provided all other terms and conditions of the current contest have been met.
14. Before taking possession of the prize, the contest winner must sign a release form relieving the Organizers, their affiliate companies and agents from all liability with respect to any damages that may be sustained directly or indirectly from participation in the contest or from the acceptance and use of the prize.
15. The contest is open to residents of Canada (excluding companies, partnerships or other businesses) who have reached the age of majority where they reside and who are eligible participants according to these rules, with the exception of members of personnel, agents and representatives of the Organizers or their affiliates (defined as all of the companies affiliated with TD Bank Financial Group), their advertising or promotion agencies, and the suppliers of the prize, equipment and services related to this contest, and any persons living under the same roof.
16. By participating in this contest, the winner authorizes the Organizers and their representatives to use his/her name, place of residence, photographs, image, voice and/or statements regarding his/her prize for advertising purposes (such as Internet and print ads) without any compensation.
17. For the purpose of these rules and subject to the eligibility criteria set out herein, the participant is the person whose name appears on the electronic quote form or who calls to request a quote. In the case of existing home/and or automobile insurance policyholders, the participant is the named insured that appears on the insurance policy. In the event that more than one person’s name appears on the winning entry, all such persons will be jointly declared winners of the prize. They will then have to decide among themselves who will answer the mathematical skill-testing question and who will get the prize. In case of a disagreement between them, the Organizers reserve the right to decide who will be asked the skill-testing question and to whom the prize will be remitted.
18. The Organizers, their affiliated companies, their advertising and promotional agencies, their respective employees, agents and representatives are not liable for faulty computer components, software or links, the loss or non-existence of communications capability, or faulty, incomplete, incomprehensible, or erased computer or network transmissions that render an individual ineligible for this contest. The Organizers, their affiliated companies, their advertising and promotional agencies, their respective employees, agents and representatives waive all liability from any damage or loss that could arise, directly or indirectly, in whole or in part, from downloading any software and by transmitting any data relating to the participation in this contest. Persons found tampering with or abusing any aspect of this contest, as solely determined by the Organizers, will be disqualified. If disqualified for any of the above abuses, the Organizers reserve the right to terminate a participant’s eligibility to participate.
19. The Organizers reserve the right, at their sole discretion, to cancel, modify, terminate or suspend this contest, in whole or in part, if an event or any human intervention corrupts or affects the administration, security, impartiality or the normal running of the Contest as provided for in these rules, subject to the approval of the Régie des alcools, des courses et des jeux du Québec (“Régie”), if required. In all cases, the Organizers, their affiliated companies, their advertising and promotional agencies, their suppliers of material or services related to this Contest as well as their respective employees, agents and representatives cannot be held to award more prizes or to award the prize otherwise than in compliance with these rules.
20. By entering this contest or trying to do so, all persons release the Organizers, their affiliated companies, their advertising and promotional agencies, their respective employees, agents and representatives from any damage which could arise directly or indirectly from their participation or attempt to participate in the contest.
21. For Québec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
